Your case is far from over! Often times, cases where benefits should be granted are denied, either because of paperwork errors, errors on the part of the Social Security Administration, (SSA) or other factors. The key to resolving this is having a firm like us review your case. At WK White, we will look over every aspect, detail, and document involved in your case to make sure no clerical errors get your benefits denied. We will also help you file an appeal request with the SSA.
This is where you file to have your claim reviewed by another person from SSA. This helps to avoid bias, as well as make sure one person’s oversight does not cost you your benefits. However, only about 14 percent of all claims are reversed upon reconsideration, so expect to continue to stage three.
In this stage, a hearing is conducted to determine if your benefits should be awarded. This hearing is presided over by an Administrative Law Judge, (ALJ) who acts as the judge of fact. These hearings can feature witness testimony, as well an opportunity for you to speak on your own behalf about why you can no longer work and need SSI/SSDI benefits.
The requirements for Social Security Disability eligibility are relatively straight forward, but can be tricky since no two situations are ever exactly the same.
